In these Terms and Conditions “we” and “us” mean Pepper & Dunn – ABN: 52 631 203 828 and “you” and “your” means you the customer.
These Terms and Conditions together with your order constitute the entire Contract between us and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email prior to the event
Terms of Contract
When you place an order with us, you are making an offer to buy our products. We will charge your credit or debit card or PayPal account at the time of checkout. We will send you an e-mail to confirm that we have received your order (the Order Confirmation) however it does not indicate that a contract between us exists.
We will accept your order, and hence a contract between us, when we send you an e-mail confirming dispatch details (the Dispatch Confirmation). In the unlikely event that the products are no longer available, or a pricing mistake has been made, we will advise you of this as soon as possible and will provide you with a full refund taken on your order, upon which point there will be no contract between us.
While each care has been taken to make sure product information is as correct as possible, all information provided is meant to give a general description of the merchandise and is provided in honesty. Food merchandise particularly are constantly being modified and reformulated by manufacturers and we would thus suggest that you do not rely solely on the information on our website and always check product labels or contact the manufacturer. Pepper & Dunn are unable to accept liability for any incorrect information.
Images of merchandise on this website are for illustrative functions only. We will continually send you the newest merchandise offered by our suppliers therefore your products could vary slightly from the image shown on the website thanks to manufacturer changes.
Placing Your Order
You can use our website to place an order by selecting the maternity gift you wish to buy and addingit to your shopping cart. Items you do not want to purchase can be removed from your shopping cart at any time.
The buyer assumes responsibility for the merchandise being appropriate for the purpose for which they are being purchased and for the accuracy of any personalisation messaging or details to accompany the products purchased.
All prices quoted on our website are in Australia Dollars. (AUD). All prices are inclusive of GST, where applicable. All shipping and delivery costs are calculated upon check out.
Please note: your country may impose additional import taxes and duties and these will be for your own account.
You will be required to pay for the products at the time of ordering. We use secure encrypted payment facilities for online purchases. You can pay for your order by credit and debit cards and PayPal. We only accept payment in AUD.
Prices are liable to change at any time, but changes will not affect orders which we have already sent you a Dispatch Confirmation for.
Promotional prices only apply during the period stated. Only coupon codes obtained from us will be honoured.
Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.
Payment Methods and Processing
Pepper & Dunn accepts PayPal, Visa, MasterCard and Afterpay only.
Payment can also be made by direct deposit to our bank account. Orders paid for by direct deposit will not be processed until payment has been received. Please ensure that you include the order/ invoice number in the transaction description.Payment processing will not begin until we receive all the information we need.
Orders placed on a weekend or a public holiday will not begin payment processing until the next business day.
Business days are Monday through Friday, excluding NSW public holidays.
For credit card and PayPal payments we will email a tax invoice to you with your order confirmation. Your tax invoice is your proof of purchase.
Shipping & Delivery
Your order will be dispatched within 5-6 working days. Orders placed on weekends or a public holiday will not begin payment processing until the next business day. You will receive an email to let you know when your order has been dispatched (the Dispatch Confirmation).
We will deliver the product to the premises you specify on your order. It is your responsibility to ensure that the address details that you provide are correct. This should include a contact name, house number and street name with a postal code. A contact phone number and email address for the recipient is required at checkout should the delivering courier need to contact them regarding delivery. Pepper & Dunn will not be held accountable for any incorrect address details provided by the customer.
With Australia Post we recommend that your nominated delivery address is one where someone is present to accept your delivery between the hours of 9:00am and 5:00pm. If no-one is present to accept delivery, the satchel will be taken to the nearest post office depot.
Pepper & Dunn is not responsible for lost or stolen packages confirmed to be delivered, including loss or damage if the courier has to leave the merchandise unattended. Upon enquiry, Pepper & Dunn can confirm delivery address the delivery was made to, date of delivery & tracking information to the customer to investigate.
If you alter the delivery address once the merchandise have been dispatched, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.
If your order has not arrived within the designated time please call or email us.
Please check the merchandise on delivery – any products found to be missing or broken should be notified to us within 24 hours of delivery of the items.
If an order is refused by the recipient we cannot refund the value of the products or shipping.
Where a component of a gift set is out of stock we will provide a substitute product of equal value to the out of stock item.
If you find that the goods were damaged in transit or were faulty in some manner, please contact us within 24 hours of receiving the goods. We will organise for the return of the goods and arrange a credit towards your next purchase or send a replacement product. Customer will incur the cost of return postage and be credited the purchase price only.
Products Damaged in Transit
All orders are delivered by Australia Post or by our nominated Courier Service which is an independent courier company. Please do not ASSUME that your package will be delivered by one service or another. Unless you tell us otherwise, we will choose the most appropriate delivery option as outlined above. Please consider the information below so you are aware of your obligations in relation to delivery options.
Australia Post satchels are NOT insurable. It is however, a much quicker service in general. Damage, loss or theft incurred as a result of using this delivery option is at the purchasers risk.
If you REQUIRE a fully insured postal service such as Australia Post Registered that must be signed for, rather than being left at your door, it is your responsibility to request this at the time of ordering. Australia Post Registered automatically includes $100 insurance. Additional fees are payable for full insurance and person-to-person delivery options.
Our courier company fully insures all their deliveries up to $1000. As stated above, if you require a fully insured service, it must be requested at the time of ordering. Our courier will endeavour to supply you with the product you have ordered from us in the condition that the goods were dispatched. However on occasion goods may be damaged in transit to you.
Pepper & Dunn is proud to offer our customers quality products. We will endeavor to supply you with product your have ordered in good condition. However, on occasion goods that are sealed within cartons may be faulty as a result of a manufacturing defect from our suppliers.
Limitation of Liability
Information on this website is provided ‘as is’ and we disclaim all representations, warranties and conditions, express or implied of any kind, including to the extent permitted by law, as to satisfactory quality or fitness for purpose.
While we make every effort to ensure that the information contained within the website is complete, accurate and current, we expressly do not guarantee that the information is complete, accurate or current and assume no responsibility for any errors or omissions of any kind in the content of the website.
We reserve the right to amend or supplement the information supplied on this website without prior notice.

Pepper & Dunn shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Pepper & Dunn, and Pepper & Dunn shall be entitled to a reasonable extension of time for the performance of such obligations.
These Terms and Conditions shall be governed by and construed in accordance with the laws of NSW and shall be subject to the non-exclusive jurisdiction of the courts of NSW.
If you are under the age eighteen (18) years you can not place orders with Pepper & Dunn.
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Any orders placed and accepted by us will be deemed to be by persons over the age of eighteen (18) years.
Should Pepper & Dunn suffer any damage or other losses as a result of a transaction entered into by a minor, Elite Sports Aus reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Pepper & Dunn.
